  1. Payment Terms

    • Hourly Rate:
      • Onsite Visit: The service fee is firmly set at $150 + GST per hour, with a minimum charge of one hour. This applies even if the service duration is as brief as 1 minute. Should the service extend beyond one hour, the billing will continue in 15-minute increments, consistently at $150 + GST per hour. This pricing structure ensures clear, predictable billing, emphasizing the value and expertise of the service provided by Auckland Geeks.
      • Remote Session Service: Rate Calculation: The cost for remote services is based on our standard hourly rate of $150 + GST, prorated to the precise duration of the remote assistance provided.
    • Payment Methods: Payment for services must be made in cash or via EFTPOS at the conclusion of the appointment, before the technician departs. If an alternative arrangement has been agreed upon with the technician in advance, an invoice will be issued and is payable within two days from the end of the appointment. Credit card payments are also accepted on-site through a portable EFTPOS machine or over the phone. However, please note that a 3% surcharge will be applied to cover processing fees, and this surcharge extends to Paywave transactions.
    • Late Payment Policy: Payments must be settled within 30 days of the invoice date. To encourage timely payment, a 25% late fee will be applied to any amounts that remain unpaid after this period.
  2. Appointment Cancellation Policy

    • Appointment Cancellation: To maintain efficiency and respect the scheduling commitments of our technicians, Auckland Geeks requires customers to cancel any appointments at least 6 hours before the scheduled time. This policy helps us manage our resources effectively and accommodate other clients who may need our services.
    • Cancellation Fee Structure:
      • If a cancellation is made within 6 hours of the appointment time, a fee of $30 will be charged. This fee compensates for the allocated time and resources that could have been utilized for other client appointments.
      • A higher fee of $50 is imposed for cancellations made within 30 minutes of the appointment time, reflecting the increased inconvenience and potential lost opportunity to serve other clients.
      • In cases where the technician arrives at the location and the customer is not present (a no-show) or cancels the appointment upon the technician’s arrival, a charge equal to 50% of the hourly rate will be applied. This fee accounts for the technician’s time, travel expenses, and lost opportunity to provide services to other customers.
  1. Service Policy

    • No Fix, No Fee Policy: Auckland Geeks commits to a fair service policy where charges are only applied if a resolution is achieved. In the event that our technicians are unable to resolve the issue due to a lack of requisite knowledge or experience, no fee will be charged. Conversely, if additional diagnostic time is needed but declined by the customer, or if the customer rejects a recommended solution, then charges will be incurred based on the time our technicians have invested in the service.
      •  Exceptions to No Fix, No Fee Policy: The No Fix, No Fee policy does not apply to data recovery jobs. For these services, regardless of the outcome, charges will apply with a minimum of one hour’s fee. Data recovery encompasses efforts to retrieve or salvage data from damaged, failed, corrupted, or inaccessible storage media when it cannot be accessed normally. Examples of data recovery jobs include:
      • Retrieving files from a malfunctioning hard drive
      • Restoring data from a damaged smartphone or tablet
      • Recovering lost photos from a corrupted memory card
      • Salvaging business data from a failed server
      • Restoring backups from damaged external storage devices
    • Travel Policy: No travel fee is charged for locations within Auckland’s borders, defined from Albany in the north to Papakura in the south, and from Howick in the east to Massey in the west. Outside these areas, a travel fee of $30 incl GST applies.
  2. Data and Device Handling

    • Data Loss: Auckland Geeks, operating under GSS Digital Services Ltd, prioritizes the integrity and safety of your data during repair services. While our intention is always to safeguard your data, unforeseeable incidents can lead to data loss. Therefore, Auckland Geeks cannot be held liable for any data loss that may occur during the repair process. We strongly advise customers to ensure that all crucial data is backed up prior to servicing, as this responsibility rests solely with the customer.
    • Data Protection: At Auckland Geeks, we hold data confidentiality in the highest regard. Access to your data will be strictly limited to what is necessary for completing the service and will only be conducted with your informed consent. Our technicians are committed to handling your data with the utmost care and discretion, ensuring that your privacy and data security are maintained throughout the service process.
    • Service Timeframe: The typical timeframe for inspection and repair is seven working days from the date of device pick-up. However, this period can be adjusted based on prior agreement with the customer. We endeavor to complete all services within this timeframe, but we will communicate with you if more time is needed to ensure a thorough and effective repair.
  3. Collection and Legal Fees

    • Collection Process: In the event of non-payment that necessitates third-party collections, the customer will be liable for all associated legal and collection fees. This liability may extend up to $15,000, covering the costs incurred by Auckland Geeks in the collection process.
  4. Safety and Accessibility

    • Safety of the Property: It is the customer’s responsibility to ensure that the premises our technicians visit are safe and clean. This responsibility includes securing any pets and maintaining a hazard-free working environment. If upon arrival or during the job, the technician deems the environment to be unsafe or unclean, they reserve the right to terminate the service immediately. In such cases, the customer will still be liable to pay for the full amount of the scheduled service. This policy is in place to protect the well-being of our staff and ensure they can perform their duties effectively and safely.
    • Parking Provision: Customers are required to ensure accessible parking is available for Auckland Geeks technicians upon their visit. In instances where the only available parking is within a paid parking zone, it is the customer’s obligation to bear the cost of these parking fees. This policy is designed to facilitate the timely and efficient delivery of our services, ensuring that technicians can focus on the task at hand without the added concern of parking constraints. It is recommended that customers arrange suitable parking arrangements prior to the technician’s arrival to streamline the service process.
  5. Liability and Indemnification

    • Limitation of Liability: Auckland Geeks shall not be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to, loss of profits, business interruption, loss of business opportunity, or other pecuniary loss, even if advised of the possibility of such damages. The liability of Auckland Geeks, if any, for direct damages arising out of the services provided under these terms shall not exceed the total fees paid by the customer for the specific service that gave rise to the claim.
    • Indemnification by Customer: The customer agrees to indemnify, defend, and hold harmless Auckland Geeks, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, fines, penalties, or costs of whatsoever nature (including reasonable attorneys’ fees and costs) arising out of or related to (a) the customer’s use of the service; (b) the customer’s breach of any terms and conditions provided herein; or (c) any negligence or willful misconduct by the customer.
    • Loss or Damage of Device: At Auckland Geeks, we take great care to ensure the safety and integrity of your devices while under our care. However, in the rare event that a device is lost or damaged, we are committed to rectifying the situation to the best of our ability. If a device is damaged, we will endeavor to repair it to the condition it was in at the time of pick-up. Should the device be irreparably damaged or lost, Auckland Geeks will provide a replacement that is comparable in functionality and value to the original device. This replacement will be sourced in a manner that is reasonable and fair, reflecting the current market value of the lost or damaged item. Our objective in such circumstances is to ensure customer satisfaction and maintain trust by offering a suitable and just resolution to the incident.
  6. Force Majeure

    • Force Majeure: Auckland Geeks will not be held liable for any failure to perform its obligations where such failure results from any cause beyond Auckland Geeks’ reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation, natural disasters, strikes, or other labor disputes, or any other cause which could not be prevented despite the reasonable care and foresight of Auckland Geeks.
  7. Amendments

    • Amendments to Terms and Conditions: Auckland Geeks reserves the right to amend these terms and conditions at any time. All amendments will be effective immediately upon notification to the customer. It is the customer’s responsibility to review the terms and conditions periodically to ensure awareness of any changes.
  8. Agreement to Terms and Conditions

    • By accepting this appointment, the customer acknowledges and agrees to be bound by all the terms and conditions outlined above. This acceptance constitutes a binding agreement between the customer and Auckland Geeks, confirming the customer’s understanding and consent to comply with these terms in their entirety.
